The Philadelphia Museum of Art (the “Museum”) provides www.philamuseum.org and its subdomains (the “Websites”) in support of its mission, which is to foster a broad understanding and appreciation of the visual arts by presenting, conserving, and interpreting the works of art in its care for the benefit of the public.
TERMS AND CONDITIONS OF USE. By accessing the Websites, you agree to be bound by the following terms and conditions, which the Museum may revise from time to time. You are encouraged to visit this page periodically to review current terms and conditions.
GOVERNING LAW AND JURISDICTION. By accessing the Websites and with respect to your use of any content on the Websites, you agree that the laws of the Commonwealth of Pennsylvania and the United States govern this agreement and you consent to the jurisdiction of Pennsylvania and U.S. courts.
INTELLECTUAL PROPERTY. The Museum respects intellectual property rights and is committed to acting in accord with the provisions of U.S. law that protect the rights of creators and owners and encourage the lawful use and creation of more intellectual property. Unless specific content is identified as belonging to the public domain, you should assume that copyrights and other rights in data, images, software, documentation, text, video, audio, and other information on the Websites (the “Materials”) may be held by the Museum, its licensors, or other third parties. The Museum retains all its rights in any of the Materials to which it has copyright.
USE OF THE MATERIALS. The Materials are provided in furtherance of the Museum’s mission and as such they may be used for purposes such as criticism, comment, news reporting, teaching, scholarship, research, or any other “fair use” or personal use under U.S. copyright law. You agree that you will not use the Materials for any other purpose and will not otherwise violate the Museum’s or any other party's intellectual property rights. You are responsible for obtaining any rights, permissions, or consents from any party that may be required for your particular use. Users should cite the source of the Materials and the citations should include a link to www.philamuseum.org.
INDEMNIFICATION. You agree to hold the Museum harmless from and against any claims, damages, expenses, costs or liabilities arising in any way from your use of the Websites and the Materials, as well as to indemnify the Museum against any such claims.
USE OF IMAGES OF ARTWORKS. With regard to images of artworks included in the Materials, the Museum understands and is committed to furthering the appreciation and study of an artwork that documentary images can facilitate. Accordingly, in order to provide the most useful Materials for this purpose, the Museum has provided digital images of many artworks in the highest resolution it is able to share, and has made them available for download. These images are generally of artworks in the public domain. In some cases, as indicated, high-resolution files may not be available for download.
Where known, the Museum has identified any rightsholders using the best reasonably obtainable information but makes no representation or warranty with respect to the accuracy or completeness of any such information. NO WARRANTIES. TRADEMARKS. Many of the trademarks, service marks and logos (“Trademarks”) displayed on the Websites, including PHILADELPHIA MUSEUM OF ART, RODIN MUSEUM and PMA, are marks of the Philadelphia Museum of Art which are registered or otherwise protected by law. The Trademarks of third parties may also be displayed on the Websites. Nothing contained in the Websites should be construed as granting any license or right to use any Trademark without written permission of the Museum or third party that may own the Trademark.
DIGITAL MILLENNIUM COPYRIGHT ACT (“DMCA”). The Museum is committed to complying with U.S. copyright and other laws and requires all users of the Websites to comply with these laws. Owners of copyrighted works who believe that their rights under U.S. copyright law have been infringed should report their concern by providing notice to the Museum’s Designated Agent pursuant to DMCA. If any provision of this agreement is deemed unlawful, void, or unenforceable, that provision will be severable from the remaining provisions and will not affect their validity and enforceability. The Museum’s failure to enforce a provision on any occasion shall not be construed as a waiver of such provision.
